HUD-approved new home warranties specifically define a builder’s warranty responsibilities and establish a contractual obligation on the part of the builder and on the part of the warranty company to assure those obligations are met.
A warranty company cannot guarantee satisfaction or that a home will be free of defects. However, because they must meet the defined warranty obligations should the builder default, their profitability depends on screening their builder members to determined that each has a track record of performance and reasonable expectations of continued performance.
Criteria for approving or declining a builder vary from one warranty company to another, but may include the following:
- Credit references
- Customer references
- Review of Financial Statements
- Confirmation of proper licensing
- Lien report reviews where available
- On-site construction inspections
